Conditions of Use

The following General Terms and Conditions of Trade apply to use of the Internet site of I-Motion GmbH and to all the resultant contractual relationships with persons ordering products or services, and with users and customers.
These General Terms and Conditions of Trade are deemed accepted in their current form as soon as the first order is placed. Furthermore, they are also valid for all future business transacted without there being any need for special reference to them.
No General Terms and Conditions of Trade of the customer and in particular terms and conditions of purchase can be accepted.

Contractual Partner:

The customer's contractual and contact partner is I-Motion GmbH, Koblenz, Germany.

Offerings:

The offerings are in each case without obligation and are not binding. No responsibility is accepted for the accuracy (in particular with regard to colour, form and appearance) and completeness of any product illustrations and descriptions in our shop.
We reserve the right to make changes to the products, product descriptions and the Terms and Conditions of Trade without prior notice.

Prices:

The prices include the VAT/sales tax applicable at the moment (19%) and are unit prices unless otherwise indicated. The agreed prices do not include additional services. Carriage paid and free delivery is only possible after prior special arrangement. The prices are valid until publication of a new price list.

Conclusion of a Contract:

The offer to enter into a contract for the price given in the order form is instigated solely by the person ordering. It is done by the orderer entering all the information necessary on the order form and then transmitting it.
The offer of a contract is accepted by I-Motion GmbH sending an acknowledgement by e-mail.

Warranty and Delivery:

Delivery of the article or product ordered is only while stocks last. In the event that an article should no longer be available, I-Motion GmbH reserves the right to provide an equivalent alternative.
Delivery of the goods ordered and admission tickets is at the orderer's expense and risk.

The product sent remains the property of I-Motion GmbH until delivery and payment thereof. This applies to all the methods of payment given in these terms and conditions of business.

In accordance with the statutory right of revocation, it is possible to withdraw from the contract within 14 days of receipt of the goods without giving any reasons.
For observance of the deadline it is necessary to return the article within the time allowed. In the event of a product being returned, the customer shall assume the costs incurred if the product delivered corresponds to the product ordered.

If the customer is responsible for damage to the product he shall pay compensation for the loss in its value.
There is no right of revocation for any of the articles if the original packaging has been removed. The right of revocation in the case of sound carriers and software lapses if the seal has been broken on the product.
Returning admission tickets is only possible if an event has been cancelled. In such as case the purchaser must return the admission tickets without delay and not later than 14 days after the original date of the event.
It should be noted that if an event is cancelled and the admission tickets are returned, 2.00 euro will be deducted from the booking fee and retained as an administrative charge.
It is no longer possible to refund the purchase price if the admission tickets are returned later than this specified time.
Damage to goods in transit and visible defects, as well as visible or concealed differences in quantities must immediately be reported by telephone, in writing or by e-mail and not later than 3 days after delivery of the article to the place of destination. No complaints or notice of any defects can otherwise be entertained.

Payment:

Goods are delivered on the basis of COD (cash on delivery) and payment in advance (bank transfer, credit card, direct debiting). The total amount will be displayed as "I-MOTION GMBH 56070 KOBLENZ" on your credit card invoice.

Where the COD method of payment is chosen, payment shall be in cash to the Deutsche Paket Dienst (DPD = German Parcel Service) upon receipt of the consignment.

Where payment is made in advance, this shall be prior to dispatch and by bank transfer, credit card or direct debit.

In the event of the customer not accepting a product ordered, the costs arising for packaging, dispatch and processing shall be reimbursed. A flat rate of 10.00 euros will be charged in such a case.

Data Protection:

The data necessary for an order are captured internally, and stored and treated with the utmost confidentiality. None of the data whatsoever is passed on to third parties. We reserve the right, however, to send information on events from time to time. Personal data is collected and stored exclusively in accordance with the statutory regulations of the Federal Data Protection Act (BDSG), with the Information and Communications Services Act (IuKDG) and the Teleservices Data Protection Act (TDDSG).

Final Provisions:

Should any parts of these Terms and Conditions of Trade be invalid this shall not affect the validity of the contract or of the remaining Terms and Conditions of Trade.
These terms and conditions and all contracts shall exclusively be governed by and construed in accordance with the laws of the Federal Republic of Germany.
The sole place of performance for all claims arising out of this contractual relationship shall be Koblenz.
If both parties to the contract are businessmen/business women, the sole place of jurisdiction for all disputes arising directly or indirectly out of the contractual relationship shall be Koblenz.
